Terms of Service

Last updated: 19 October 2026

Overview

Welcome to HUGNEST. This store is operated by Brigitt Oliva Acero, trading as HUGNEST, established in Spain. In these Terms, “we”, “us” and “our” refer to the seller, not to Shopify or our suppliers.

These Terms govern your use of our website and purchases from our store. Our Shipping Policy, Refund Policy and Privacy Policy provide additional information about delivery, returns and personal data. Please read them before ordering.

Our store is hosted by Shopify, which provides the technology used to operate it. Your purchase contract is with the seller identified above.

Nothing in these Terms excludes or restricts any mandatory consumer rights. If a clause conflicts with a right that cannot legally be waived, that right takes priority.

1. Access and accounts

To place an order, you must have the legal capacity to enter into a purchase contract, or have the authorisation required by applicable law.

Provide accurate, complete and current contact, billing, delivery and payment information. You must be authorised to use the payment method submitted.

If you create an account, keep your credentials secure and notify us promptly of suspected unauthorised access. You are responsible for your own misuse of the account, but not for losses caused by security failures for which we are legally responsible. An account is not required to contact us about a return or cancellation.

2. Product information, sizing and use

We aim to describe products accurately. Screens and lighting can cause minor differences in perceived colour. This does not excuse goods that materially differ from their description, advertised characteristics or applicable legal requirements.

Please compare the measurements in the size chart with a suitable garment before ordering. Choosing the wrong size does not remove your applicable return rights. We remain responsible if an item is incorrectly supplied or does not match the stated measurements within any properly disclosed, reasonable tolerance.

Follow the care, fitting and use instructions supplied for the exact model purchased. Product photographs and marketing materials do not replace those instructions. Do not use a garment or pocket to support or carry a child unless the exact model is expressly designed and documented by its manufacturer for that purpose, including the required support system and age and weight limits.

We may take account of damage caused by misuse, unauthorised alterations or failure to follow appropriate instructions when assessing a claim, to the extent permitted by law. This does not exclude responsibility for defective goods, inadequate instructions or misleading descriptions for which we are responsible.

3. Orders and acceptance

Submitting an order is an offer to purchase the selected goods at the stated price. A purchase contract is formed when we confirm acceptance of your order. A message that merely acknowledges receipt, or a payment authorisation by itself, does not necessarily constitute acceptance.

Before acceptance, we may decline an order for a genuine reason such as unavailable stock, an inability to deliver to the specified address, a material pricing error or reasonable suspicion of fraud. Where appropriate, we may request proportionate information necessary to verify the transaction.

If we cannot accept or fulfil an order, we will notify you and promptly return any payment collected, within applicable legal deadlines. We will not substitute a different product or charge a higher price without your agreement.

Once a contract has been formed, any cancellation or change by us must comply with applicable law and these Terms. We cannot cancel an accepted order arbitrarily.

4. Prices, payment and promotions

The product price, checkout currency, applicable taxes and any delivery charges payable to us will be shown before you confirm payment. Check the final total carefully. Your bank or payment provider may apply its own currency-conversion charges.

If an international delivery could involve import duties or charges payable separately to a third party, the applicable arrangements will be explained before purchase as required by law. This clause does not permit undisclosed additional charges.

Prices and promotions may change for future orders. Changes do not retrospectively alter an accepted order. Specific promotional conditions will be disclosed before purchase and cannot override mandatory consumer rights.

We may refuse unauthorised or fraudulent payments. We do not impose additional charges or penalties merely because a customer exercises a lawful cancellation, complaint or payment-dispute right.

5. Shipping and delivery

HUGNEST offers worldwide shipping with delivery taking up to 14 calendar days from the date an order is placed, as stated in our Shipping Policy, unless a different timeframe is expressly agreed before purchase.

Please provide a complete, deliverable address and notify us promptly if it is incorrect. We will try to accommodate an address change before dispatch but cannot guarantee that a parcel already dispatched can be redirected.

If an address error attributable to you causes a failed delivery, we may propose reasonable, evidenced additional delivery costs where legally permitted. We will explain these costs before arranging another shipment. You will not be charged for delivery errors for which we are responsible.

Where we arrange transport for a consumer purchase, responsibility for loss or damage remains with us until you, or a person you nominate other than the carrier, physically receives the goods, subject to any lawful exception for transport independently arranged by you.

If an order is delayed or missing, contact lypaw730@gmail.com. Carrier problems or circumstances outside our control do not automatically remove your rights to delivery, cancellation or a refund. We will investigate and provide any remedy required by law.

6. Returns, refunds and exchanges

Our Refund Policy explains how to request a return, cancellation, refund or exchange. We offer a voluntary 30-day period from receipt to request a return, in addition to any applicable statutory rights.

Conditions concerning unused items, tags and original packaging under our voluntary policy do not restrict rights to inspect goods, cancel eligible distance purchases or obtain a remedy for faulty or incorrectly supplied goods.

Contact us before sending a return so we can provide the correct destination and instructions. Notifying us of a statutory cancellation does not require our prior approval.

For change-of-mind returns, the customer pays return shipping where this was properly disclosed and permitted by law. We cover the necessary return costs for defective, damaged or incorrectly supplied goods.

We may inspect returns, ask for reasonable proof of purchase and, where useful, request photographs or other proportionate evidence. A request for evidence does not automatically remove your legal rights if a particular form of evidence is unavailable. Any reduction for diminished value must be lawful and explained.

7. Cancellations and order changes

Contact us as soon as possible, ideally within 12 hours, if you want to change or cancel an order. This helps us try to stop fulfilment before dispatch; it is not a deadline that removes statutory cancellation rights.

If the order is already being processed or has been dispatched, we may be unable to change the shipment. Your applicable cancellation and return rights continue to apply.

For eligible EU/EEA and UK distance purchases, statutory cancellation rights are explained in our Refund Policy. Any legally required refund deadlines take priority over administrative processing targets.

8. Intellectual property

The HUGNEST name, branding and website content are protected to the extent that we or the relevant rights holders own or license the applicable intellectual property rights. Third-party names and materials remain the property of their respective owners.

You may use the website for personal shopping, including saving information reasonably needed for your order or legal rights. You must not unlawfully copy, commercially exploit or misrepresent our branding or protected content, infringe third-party rights, or imply an affiliation that does not exist.

Purchasing a product does not transfer intellectual property rights in the product or website content.

9. Third-party tools and links

Our website may link to external services or offer third-party functionality. Those services may have separate terms and privacy notices. Review them before using the service.

We do not guarantee content on independent websites we do not control. However, we remain responsible for our own representations and any duties that cannot lawfully be delegated to a third party. Using a payment processor, supplier or carrier does not remove our obligations as the seller.

10. Relationship with Shopify

Shopify provides the platform hosting our store. Sales contracts are between you and HUGNEST's seller, Brigitt Oliva Acero. Shopify is not the seller of our products.

Shopify's own services are governed by its applicable terms and privacy notices. Nothing in these Terms releases any party from a liability that cannot legally be excluded.

11. Personal information

Our Privacy Policy explains how personal information is handled in connection with browsing, orders, delivery and customer support. Shopify and other service providers process information as described in the applicable privacy notices.

Accepting these Terms is not blanket consent to marketing or to optional cookies. We obtain consent separately where required. See Shopify's Privacy Policy for information about Shopify's processing.

12. Reviews, feedback and submissions

You are responsible for ensuring that any review, photograph or other material you submit is lawful, accurate to your experience and yours to share. Disclose any relevant incentive or commercial relationship.

When you submit content for public display on our store, you grant us a non-exclusive, royalty-free permission to display, reproduce and technically format it for that purpose, subject to applicable privacy and intellectual property law. Private support messages are not automatically licensed for public advertising.

We may moderate unlawful, abusive, fraudulent or irrelevant content using reasonable and transparent criteria. We will not invent reviews, falsely attribute reviews or remove genuine criticism solely because it is negative.

13. Errors and availability

We may correct genuine website errors and update listings for future orders. Corrections do not automatically change an existing purchase contract.

If a material error affects your order, we will explain the issue and seek agreement on any proposed change, or provide a cancellation and refund where legally permitted. You will not be required to pay an increased price without agreeing to it.

14. Prohibited conduct

You must not commit payment fraud, impersonate another person, knowingly submit false claims, harass others, introduce malicious software, unlawfully obtain personal information, infringe intellectual property rights or interfere with website security.

We may investigate reasonably suspected fraud and preserve relevant order and support records in accordance with our Privacy Policy and applicable law. A genuine complaint, return request or payment dispute is not prohibited conduct.

15. Automated access

Automated access must be lawful and must not bypass access controls, interfere with the website or collect personal information unlawfully. We may restrict abusive scraping, fraud or disruptive automated activity.

These restrictions do not prevent lawful accessibility tools, authorised services or uses protected by applicable law.

16. Suspension and termination

We may restrict website or account access where reasonably necessary to address fraud, unlawful conduct, serious breaches of these Terms or a genuine security risk. We will give notice and reasons where appropriate and legally required.

Suspending access does not erase an accepted order, a refund due or a customer's accrued legal rights. Customers must retain a way to contact us about existing purchases.

17. Website availability and product guarantees

We take reasonable care in operating the website, but do not promise that access will always be uninterrupted or free from technical errors. We may carry out necessary maintenance.

Technical availability statements do not limit our obligations to supply goods that conform to their description and applicable legal standards. We do not exclude mandatory product guarantees by describing goods as “as is” or “as available”.

18. Liability

We are responsible for losses caused by our breach, negligence or other conduct to the extent required by applicable law.

Where legally permitted, we are not responsible for losses caused solely by a customer's fraudulent conduct, unauthorised alterations, or misuse contrary to adequate product instructions, nor for losses that were not reasonably foreseeable when the contract was made. These exclusions apply only to the extent justified by the circumstances and the law.

Nothing excludes or limits liability for death or personal injury where it cannot legally be excluded, fraud, mandatory product liability, defective performance, or any other non-excludable consumer right. No general purchase-price cap applies where it would unlawfully restrict compensation.

Products are offered for personal and household use. Where legally permitted, we do not accept liability for business losses arising from commercial use that was not agreed with us. This does not remove non-excludable liability.

19. Responsibility for unlawful conduct

A party may seek recovery for loss directly caused by another party's fraud, unlawful conduct or breach where applicable law allows it. This is not an automatic obligation for consumers to indemnify HUGNEST, Shopify, our suppliers or their lawyers for every claim or expense.

Any recovery must be legally justified and proportionate. You are not responsible for losses caused by our own breach or negligence.

20. Severability and interpretation

If a provision is unlawful or unenforceable, it will not bind the customer. The remaining Terms continue only to the extent that they can lawfully operate without that provision.

Mandatory consumer rights take priority. Ambiguous terms will be interpreted in accordance with applicable law, including rules protecting consumers.

21. Entire agreement and transfer

These Terms, the applicable store policies and information provided before purchase form the relevant contractual documents, subject to mandatory law. This does not erase binding product descriptions, pre-contract information or specific commitments made to you.

A failure to enforce a right immediately is not necessarily a waiver of that right.

We may transfer our business or contractual obligations only where lawful and without reducing your rights or guarantees. We will provide any required notice or seek consent where necessary. Customers may transfer rights where the law permits.

22. Governing law and disputes

These Terms are governed by Spanish law. If you are a consumer, this choice does not deprive you of mandatory protections applicable in your country of habitual residence.

Please contact lypaw730@gmail.com if you have a complaint. We will try to resolve it fairly. Contacting us is not a condition that prevents you from exercising legal remedies or meeting a payment-provider deadline.

Jurisdiction is determined by applicable law. You are not required to bring a claim exclusively in Madrid or Spain where consumer law gives you the right to use another competent court. We do not impose mandatory arbitration or waive non-waivable rights.

23. Language and translations

The store provides these Terms in English. Where translations are available, we aim to keep them consistent. No language-priority clause overrides mandatory consumer protections or applicable interpretation rules. Nothing requires proceedings to be conducted in English where the law provides otherwise.

24. Headings

Headings are provided for ease of reading and do not override the substance of these Terms.

25. Electronic communications and records

We may send order confirmations, service notices and other transactional messages electronically. Keep your email address current and retain your order confirmation, payment records and correspondence.

We may retain appropriate order, delivery and support records for legitimate operational and legal purposes, in accordance with our Privacy Policy. Marketing communications require a separate lawful basis.

26. Changes to these Terms

We may update these Terms for future transactions and will provide any notice required by law. The version applicable when your purchase contract was formed governs that purchase, unless a later change is required by law or validly agreed with you.

Website updates do not retrospectively reduce rights attached to an existing order. The date above identifies this version.
